Mitchell found guilty of murder of Huber Heights woman

DAYTON — Prosecuting Attorney Mat Heck, Jr. announced that Ryan David Mitchell, 30, was found guilty as charged on all counts and specifications, except for a single count of burglary, in the shooting death of 26‐year‐old Melissa Nilson on Feb. 21, 2014.

During the early evening hours of Friday, Feb. 21, 2014 the defendant shot the victim to death in the front yard of her home on Cree Avenue in Huber Heights. The defendant then took the victim’s car and fled the scene, passing police officers who were responding to 911 calls about the incident.

The defendant crashed the car on Rip Rap Road, and fled from the vehicle as police officers were arriving. The defendant ran to a local bar, Jack Ass Flats, and broke into the building.

Police officers placed the defendant into custody after a brief struggle.

After a jury trial more than a week long, the defendant was found guilty as charged on:

  • Three counts Murder.
  • Two counts Felonious Assault.
  • One count Grand Theft of a Motor Vehicle.
  • One count Assault on a Police Officer.
  • One count Having Weapons While Under Disability.
  • One count Failure to Stop After an Accident.
  • One count Failure to Comply with an Order or Signal of a Police Officer.

The defendant has been in custody in the Montgomery County Jail, being held on a $1,000,000 bond, since his arrest. He will be sentenced on Oct. 6 at 9:15 a.m.

Prosecutor Heck continued, “This defendant, who has previously been sentenced to prison for other crimes, coldly and without provocation shot and killed the mother of a four-year-old child, then fought with officers when they apprehended him.”
