DAYTON — A 21-year old Dayton man has been found guilty on all charges in the shooting death of 19-year old Joshua Lamar Hamilton outside Kricket’s Bar last September.
Michael Daren Scott was found guilty by a Montgomery County Jury of two counts of murder, two counts of felonious assault, one count of having a weapon under disability, and one count of illegal possession of a firearm in a liquor permit premises.
Scott remains in custody at the Montgomery County Jail and will be sentenced on September 2, 2016 at 11:30 am.
“This defendant, who was legally prohibited from possessing a gun, coldly shot and killed the victim after a brief argument,” said Montgomery County Prosecutor Mat Heck, Jr. “He is clearly a dangerous and violent offender who never acknowledged his guilt.”
During the early morning hours of Sunday, September 27, 2015, just after closing time, an altercation occurred at Kricket’s Tavern on Brandt Pike in Huber Heights. During the altercation, witnesses reported seeing the victim being beaten and assaulted, before being fatally shot by the defendant.
Eyewitnesses assisted the Huber Heights Police Department in identifying the defendant from video and photographic evidence.
The murder and felonious assault counts have 3‐year firearm specifications because the defendant used a gun. The defendant was under disability, and was not allowed to possess a firearm due to a prior adjudication of an offense of violence as a juvenile.
